📜 TERMS OF SERVICE

Hey, welcome to Gertie. By using gertie.com.au or buying anything from us, you're agreeing to these terms. Read them — they're shorter than they look.

"Gertie", "we", "us", and "our" means GERTIES PLAYGROUND PTY LTD (ABN 37 687 466 048), trading as Gertie. "You" means anyone using our site or services.

1. WHO CAN SHOP

You must be at least 18 years old to make a purchase. By using the site, you confirm you meet this requirement, or that a responsible adult has given consent for you to use it.

Don't use our site or products for anything illegal, and don't transmit viruses or malicious code.

2. OUR SITE & SERVICES

We do our best to keep our site running smoothly, but we can't guarantee it'll always be available, error-free, or up-to-date. We may modify, pause, or discontinue any part of the site or our products at any time without notice.

Our store is hosted on Shopify Inc. — they handle the platform that powers our online store.

3. PRODUCTS & PRICING

All prices are in Australian Dollars (AUD) and include GST where applicable. Shipping costs are calculated at checkout.

We try to display product colours, sizes, and images as accurately as possible — but screen colours can vary, so what you see may differ slightly from the real thing.

We reserve the right to:

  • Change prices, descriptions, or product availability without notice
  • Limit quantities per person, household, or order
  • Refuse or cancel orders (e.g. if we suspect a pricing error or fraudulent activity)
  • Discontinue any product at any time

If we cancel or change an order, we'll contact you using the email or phone number you provided.

4. ORDERS & PAYMENT

By placing an order, you confirm that the info you've provided (name, address, payment) is current and accurate. We'll process payment securely through Shopify Payments and other approved providers.

We may refuse or cancel any order at our discretion — including orders we suspect are from resellers or for unauthorised commercial use.

5. RETURNS & REFUNDS

See our Refunds, Returns & Exchange Policy for the full details (you'll find it linked in the footer of our website). Your rights under the Australian Consumer Law always apply.

6. PRIVACY

Your personal information is handled per our Privacy Policy, available in the footer of our website.

7. INTELLECTUAL PROPERTY

Everything on this site — branding, logos, photography, copy, product designs — belongs to Gertie or our licensors. You may not copy, reproduce, modify, or commercially use any of it without our written permission. The Gertie name and logo are our trademarks.

8. USER COMMENTS & SUBMISSIONS

If you send us reviews, ideas, photos, or other content (whether we asked for it or not), you give us permission to use, edit, share, and publish it without obligation to pay you or keep it confidential.

Your submissions must:

  • Not infringe anyone else's rights (copyright, privacy, etc.)
  • Not be defamatory, abusive, obscene, or unlawful
  • Be honest about who you are

We can remove any content at our discretion.

9. THIRD-PARTY LINKS & TOOLS

Our site may link to or use third-party tools and websites (e.g. payment providers, shipping carriers, marketing platforms). We're not responsible for their content, products, or terms — please review theirs separately.

10. PROHIBITED USES

Don't use our site:

12. LIMITATION OF LIABILITY

Subject to your rights under the Australian Consumer Law, our products and site are provided "as is". To the maximum extent permitted by law, we're not liable for any indirect, incidental, or consequential losses (e.g. lost profits, lost data) arising from your use of our site or products.

13. INDEMNITY

You agree to cover any reasonable claims, losses, or legal costs we incur due to your breach of these Terms or applicable laws — except to the extent caused by our own negligence.

14. CHANGES TO THESE TERMS

We may update these Terms occasionally. The "last updated" date at the top will reflect any changes. Continued use of the site after updates means you accept them.

15. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be handled by the courts of NSW.

16. SEVERABILITY

If any part of these Terms is found unenforceable, the rest still apply.
